Terms of Service

These terms govern the use of nishmar, operated by Barak Bar Chen, Modi'in, Israel. Using the Service means you accept them.

1. The Service

nishmar receives call details and recordings of your business line from your carrier, transcribes and summarizes them, sends you summaries, and saves documents to your Google Drive if you connect it. The Service is currently running with a limited group of businesses and may change.

2. Your carrier

Calls are recorded by your carrier under your own agreement with it. nishmar is not a party to that agreement and is not responsible for the carrier's service, availability or terms.

3. Your responsibilities

• Use the Service for business purposes and in accordance with the law, including privacy and wiretapping laws, and inform call participants where the law requires it.
• Mark private numbers you do not want summarized.
• Keep your account and connected Google account access secure.

4. AI-generated content

Transcripts and summaries are generated automatically and may contain errors, omissions or wrong names. They support your work and do not replace your own review; check any detail before acting on it.

5. Fees

Price, plan and payment terms are set in the quote or order you approved. Special terms may apply during the pilot, agreed with you in writing.

6. Your data

Your data remains yours. We process it under our Privacy Policy and only to provide the Service. Documents in your Google Drive belong to you.

7. Availability

We aim to keep the Service running continuously, but it is provided "as is" without a guarantee of uninterrupted availability. A call that was not processed on time will be processed once the issue is fixed, as long as the recording is still available from your carrier.

8. Limitation of liability

To the maximum extent permitted by law, nishmar is not liable for indirect or consequential damages, and its total liability will not exceed the amount you paid for the Service in the three months before the event.

9. Termination

You may end the Service at any time by writing to hello@nishmar.com. We will then stop receiving and processing calls and delete your data from our systems within 30 days. Documents in your Google Drive stay with you.

10. Governing law

These terms are governed by the laws of the State of Israel, and the competent courts in Israel have jurisdiction.
